Terms of service

Welcome to MOEBEER. These terms of service (the "Terms") apply to every order you place with us and to your use of moebeer.com (the "Site"). Please read them carefully. They set out who we are, how we sell to you, how you can cancel or return an order, and what each of us is responsible for.
Nothing in these Terms affects your statutory rights as a consumer. Where these Terms and the law say different things, the law wins.
1. Who we are
We are MOEBEER Ltd, a company registered in England and Wales under company number 16975557. Our registered office is 52 Watling Lane, Dorchester-on-Thames, Wallingford, Oxfordshire OX10 7JQ, United Kingdom.
You can contact us by email at support@moebeer.com or by phone on +44 1865 570 265. Our Site is hosted by Shopify, which enables us to provide it to you, but every sale is made directly between you and MOEBEER Ltd.
2. Using the Site
To place an order you must be at least 18 years old, or have the permission of a parent or guardian. You agree that the information you give us when ordering or creating an account is accurate, current and complete, and that you will keep it up to date. You are responsible for keeping your account credentials secure and for any activity that happens under your account.
You may use the Site for lawful, personal, non-commercial purposes only. You must not misuse the Site: for example by introducing malicious code, attempting to gain unauthorised access, scraping or copying its contents, sending unsolicited advertising, impersonating anyone, or interfering with anyone else's use of it. We may suspend or withdraw access to the Site if you break these Terms.
3. Our products
Every MOEBEER garment is made to order: nothing is produced until you order it. We work hard to show our products accurately, but colours can look different on different screens, and small variations between the image and the garment you receive are normal for printed textiles. Product descriptions, prices and availability may change from time to time, and we may withdraw a product at any time.
4. Ordering and when a contract is formed
When you place an order you are making an offer to buy. We will send an email acknowledging your order, but the contract between us is only formed when we send you a shipping confirmation. Until then we may decline your order, for example because a product is unavailable, we cannot verify your payment, we find a pricing or description error, or we cannot deliver to your address. If we decline an order we will refund anything you have already paid.
Because production usually starts within a day of your order, please contact us at support@moebeer.com straight away if you need to change anything. Once a piece has gone into production we may not be able to change or stop it, but your cancellation and return rights in section 7 still apply.
5. Prices and payment
Prices are shown in pounds sterling and include VAT where applicable. If you shop from one of our other markets, prices are shown in your local currency. Delivery charges are shown before you confirm your order. For deliveries outside the United Kingdom, import duties, customs charges and local taxes are not included and are your responsibility; see our Shipping policy.
The price you pay is the price shown at the time you place your order, and is confirmed in your order confirmation email. If we discover a genuine pricing error before we accept your order, we will contact you and give you the choice of paying the correct price or cancelling. We accept the payment methods shown at checkout. By paying, you confirm that you are authorised to use the payment method you have chosen.
Promotions and discount codes may have their own conditions, which will be stated when the promotion is offered. Where those conditions conflict with these Terms, the promotion conditions apply to that promotion.
6. Delivery
We deliver to the destinations listed in our Shipping policy. Delivery times are estimates. Because each piece is made to order, production time is added to the shipping time shown at checkout. We will deliver within 30 days of your order unless we agree a different date with you; if we cannot, you may cancel and receive a full refund.
We are not responsible for delays caused by events outside our reasonable control, such as carrier disruption, customs processing or severe weather, but we will let you know and do what we reasonably can to reduce the delay.
The goods are your responsibility from the moment they are delivered to the address you gave us, or to a person you have nominated to receive them. You own the goods once we have received payment in full.
If you give us an incomplete or incorrect address and the parcel is returned to us, we may ask you to cover the cost of sending it again.
7. Cancelling and returning an order
Your legal right to cancel. If you are a consumer in the United Kingdom or the European Union, you have the right to cancel your order for any reason within 14 days of the day you receive it (or the day you receive the last item, where an order is delivered in parts). To cancel, email support@moebeer.com or use the cancellation form in our Refund policy. You then have 14 days to send the goods back to us. We will refund the price and our standard delivery charge within 14 days of receiving the goods back, or of you sending us proof of postage. We may reduce the refund if the goods have been handled beyond what is needed to check them, for example if they have been worn or washed.
This legal right does not apply to items personalised to your own request, such as a name, date or bespoke design supplied by you.
Our 30-day returns policy. On top of your legal rights, we accept returns and size exchanges of unworn, unwashed items in their original condition within 30 days of delivery. Return postage is on us. The conditions are set out in our Refund policy.
8. If something is wrong with your order
Under the Consumer Rights Act 2015 our goods must be of satisfactory quality, fit for purpose and as described. If a piece arrives damaged, faulty, or is not what you ordered, you are entitled to a full refund if you tell us within 30 days of delivery, or to a repair or replacement after that, and we will cover the cost of returning it. Please email support@moebeer.com with your order number and a photo so we can put it right quickly. Our Refund policy explains the process.
9. Intellectual property
Every design we sell starts as original artwork. The Site and everything on it, including our artwork, calligraphy, designs, text, photographs, video, logos and the MOEBEER name, belong to MOEBEER Ltd or our licensors and are protected by copyright, trade mark and other intellectual property laws. Buying a garment gives you the right to wear and enjoy it; it does not give you any right to reproduce, adapt or sell the artwork on it, or to use any of our content or marks for a commercial purpose without our written permission.
10. Reviews, photos and feedback
We love seeing what you do with the pieces. If you send us or post on the Site any review, photo, comment or other content ("Feedback"), you give us a non-exclusive, worldwide, royalty-free licence to use, reproduce, edit and publish it in connection with our business, including in our marketing, and you confirm that you have the right to give us that licence. You keep ownership of your Feedback.
Your Feedback must be honest, must not be misleading, and must not infringe anyone's rights or be unlawful, abusive or obscene. If you received free product, a discount or any other incentive in connection with a review or post, you must say so clearly. We may remove or decline to publish Feedback that breaks these rules, and we are not obliged to publish, respond to or pay for Feedback.
11. Third-party links and tools
The Site may contain links to third-party websites, apps or tools that we do not control. We provide them for convenience and do not endorse or take responsibility for their content, accuracy, privacy practices or terms. Please check those before using them.
12. Our relationship with Shopify
The Site is hosted by Shopify, which processes your orders and payments on our behalf. Your contract is with MOEBEER Ltd, not with Shopify, and Shopify is not responsible for any aspect of the sale between you and us.
13. Privacy
We handle your personal information in accordance with our Privacy policy. Because the Site is hosted by Shopify, some of your information is also processed by Shopify as described in the Shopify Consumer Privacy Policy.
14. Our responsibility to you
If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or of our failing to use reasonable care and skill. Loss is foreseeable if it is obvious it will happen, or if you and we both knew it might happen at the time the contract was made.
We do not exclude or limit our liability where it would be unlawful to do so. In particular, nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your statutory rights in relation to the goods, or for defective products under the Consumer Protection Act 1987.
We supply our products for domestic and private use only. If you use them for any commercial or business purpose, we are not liable to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
We are not responsible for delays or failures caused by events outside our reasonable control.
15. Errors, inaccuracies and omissions
We try to keep the Site accurate, but there may occasionally be errors or omissions in product descriptions, pricing, promotions, delivery charges, transit times or availability. We may correct these and update information at any time. Where an error affects an order you have placed, we will contact you before we accept it, as described in sections 4 and 5.
16. Changes to these Terms
We may update these Terms from time to time, for example to reflect changes in the law or in how we operate. The version in force when you place an order is the one that applies to that order. The current version is always available on this page.
17. Complaints and disputes
If you are unhappy with anything, please tell us first at support@moebeer.com and we will do our best to resolve it. We are not currently a member of an alternative dispute resolution (ADR) scheme and we are not obliged to use one, but if we cannot resolve a complaint we will let you know and, where we can, tell you about a suitable ADR provider.
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction over any dispute. If you live in Scotland or Northern Ireland you may also bring proceedings in your local courts, and if you are a consumer in the European Union you keep the right to bring proceedings in your home country and to rely on the mandatory consumer protection laws of that country.
18. General
If any part of these Terms is found to be invalid or unenforceable, the rest continues to apply. If we do not enforce a right under these Terms straight away, we can still enforce it later. These Terms are between you and us; no one else has any rights under them. We may transfer our rights and obligations under these Terms to another organisation, and we will tell you in writing if this happens; you may only transfer yours with our written agreement.
